Legal basis, clarification
The therapeutic relationship is based on a treatment contract and psychotherapy is conducted according to professional standards. Clients are informed that psychotherapy does not replace medical examinations. A medical assessment to rule out possible physical causes of the symptoms should take place beforehand.
During the course of psychotherapy, so-called healing crises and side effects may occur, which can be accompanied by more intense emotional perception. This is normal and sometimes unavoidable within the treatment process. In case of uncertainty, the client discusses this with the therapist.
Fees, duration, closing session, reimbursement
The hourly rates for psychotherapeutic treatment are specified in the fee schedule. The current version is always published on the therapist’s website.
The services provided in this practice are private services and must be paid by the clients themselves. Reimbursement by statutory health insurance is generally not possible, or only possible in exceptional cases. If supplementary private health insurance exists, clients must obtain information themselves regarding possible reimbursement.
Non-reimbursement or partial reimbursement by a cost bearer, e.g. private health insurance, has no influence on the agreed fee.
The duration of treatment depends on the symptoms and the client’s level of participation and is discussed as part of the case history within the first five probatory sessions.
Payment terms
The fee for individual sessions is payable within seven days after invoicing.
For bundled bookings (e.g. session packages), the total amount is payable in advance. Appointments can be used after payment has been received.
Appointment cancellations and cancellation fee
Agreed appointments are binding and are reserved exclusively for the respective client. Cancellation or rescheduling free of charge is possible up to 48 hours before the appointment.
For later cancellations or no-shows, the session will be charged as a cancellation fee according to the current fee schedule, as the time usually cannot be reassigned at short notice.
Cancellations can be made by phone, email, or via the agreed booking system. The decisive factor is the time the cancellation is received.
Right of withdrawal
You have the right to withdraw from the contract with
Kaiyu Huang, Heilpraktiker for Psychotherapy, within fourteen days of conclusion of the contract without giving any reason.
To exercise your right of withdrawal, a clear written declaration by email or letter to the following address is sufficient:
Kaiyu Huang
Spatzenweg 11
85238 Petershausen
Email: info@kaiyu-huang.com
To meet the deadline, it is sufficient that you send the withdrawal before the fourteen-day period has expired.
All payments already received will be refunded no later than fourteen days after receipt of your withdrawal. The same means of payment that you used for the original transaction will be used for the refund, unless otherwise agreed.
If you have expressly requested that the service begin during the withdrawal period, payment must be made for the sessions actually provided up to that point.
If a package with a discounted price has been booked and the contract is withdrawn, the sessions already completed up to the time of withdrawal will be charged at the regular single-session price. The package discount no longer applies to those sessions. Payments already made will be recalculated accordingly. The remaining amount will either be refunded or, if still outstanding, invoiced.
The right of withdrawal expires prematurely if the agreed service has been fully provided and you have expressly agreed before the start of treatment that the service should begin immediately and acknowledged that this will result in the loss of the right of withdrawal.
Termination
The treatment contract may be terminated by either party at any time without giving reasons, either verbally or in writing.
Unused and already paid services will be refunded.
If a discounted package was agreed and the contract is terminated prematurely, the sessions used up to that point will be recalculated at the regular single-session price. The discount included in the package no longer applies to the sessions already used. Advance payments will be recalculated accordingly. Any remaining balance will be refunded or, if necessary, invoiced.
In cases of repeated non-attendance, lack of cooperation, or non-payment, the therapist reserves the right to also terminate the treatment contract.
Duty to cooperate and resilience
Clients actively participate in improving their situation and recovery. If clients experience difficulties in contributing to the success of the treatment, they should discuss this with the therapist.
Clients confirm that they are sufficiently resilient for the agreed learning content and/or therapeutic approach according to the documentation. If this changes during the course of cooperation, clients will inform the therapist immediately.
Side effects
Psychotherapy may lead to changes within the clients themselves and in their environment. People around them may not always respond positively to changed behavior. This may lead to doubts about the treatment and should be discussed with the therapist.
Confidentiality
The therapist is bound by professional confidentiality. If information is to be shared with cost bearers, doctors, family members, or other related persons, the therapist must be released from confidentiality by the client in writing.
For the purpose of ensuring process quality, treatment sequences and developments may be discussed anonymously by the therapist in supervision and peer consultation groups. Naturally, the participants in these professional groups are also bound by confidentiality and may not disclose any information.
Notification of significant changes
Clients undertake to inform the therapist of significant changes in their personal life circumstances during the course of treatment, as these may require a change in treatment method, the involvement of medical advice or examinations, or a transition to another therapeutic approach or therapist with appropriate training.
Documentation | retention obligation | data protection
The therapist documents sessions in compliance with the General Data Protection Regulation (GDPR) using Lemniscus. Clients may view the documentation at any time. Copies or PDF files can be provided upon request. Clients bear the cost of printed copies. Documentation is retained for a period of 10 years.
Online treatment
Therapeutic sessions may also take place online via video by mutual agreement, provided this is professionally appropriate and responsible. The implementation follows generally accepted professional standards. Personal contact may be recommended at any time during the process if this is indicated from a therapeutic perspective.
To participate in an online session, clients need a stable internet connection and a suitable device in a quiet, undisturbed environment. Responsibility for the technical equipment on the client’s side lies with the client.
If technical disruptions, connection losses, or reduced audio or video quality occur during a session, both parties will first try to restore the connection promptly. If this is not possible, an appropriate solution will be agreed upon together, for example continuing by phone or arranging a timely replacement appointment for the part of the session that could not be conducted.
If a session cannot take place or can only take place partially due to technical problems on the client’s side, the appointment will generally be considered as attended. If the session cannot be conducted due to technical problems on the therapist’s side, clients will of course not incur any additional costs; in this case, a replacement appointment will be offered.
The agreed fees apply equally to online sessions as to in-person appointments.
Liability
The therapist is liable in accordance with statutory provisions under German civil law (BGB) for personal injury, property damage, or financial loss.
